Terms & Conditions
- The client shall provide all necessary information, including but not limited to, scripts, ideas, and concepts for the production of the video.
- The client shall be responsible for obtaining any necessary permissions, licenses or releases for the use of any copyrighted or proprietary material included in the video.
- The client shall be responsible for the final approval of the video and the company shall not be held liable for any errors or omissions once the video has been approved by the client.
- The company shall retain the right to use the video for the purpose of promoting its services.
- The company shall retain the copyright to the video, unless otherwise agreed upon in writing.
- The company shall deliver the final video in the format(s) specified by the client. Additional delivery formats may be subject to an additional charge.
- Any changes or modifications to the video after delivery shall be subject to additional charges.
- If the client cancels the project after it has begun, the deposit will not be refunded and any % of the expenses incurred up to that point will be billed to the client.
- These terms and conditions are subject to change without notice and shall be binding on both the company and the client
- The company provides no warranty on the video or its fitness for a particular use.
- These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the company is incorporated.
- Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the jurisdiction in which the company is incorporated.
- Project milestones, timelines, and deadlines should be clearly defined and agreed upon by both the client and the company before the project begins.
- The client is responsible for providing the company with all necessary assets, including but not limited to images, video footage, audio, and other materials to be used in the final video.
- The company will not be held liable for any delays caused by the client’s failure to provide necessary assets or information in a timely manner.
- The company shall be given a reasonable opportunity to correct any defects before the client can terminate the contract for any breach of contract by the company.
- The company and the client should agree on how to handle intellectual property rights and usage rights of the final video and any necessary licenses, or any property rights that may be transferred by the company to the client.
- Indicate any additional costs for client’s requests for additional revisions or changes that deviates from the original scope of the project.
- The company may sub-contract the production or any part of it, but the company remains fully liable for the performance of such sub-contractors as if they were an employee of the company.
- The company shall have no liability for any indirect, incidental, special, or consequential damages (including but not limited to lost profits) arising out of or in connection with the video production services.
